Definitions, characteristics and application of the legislation

Cookies are small text files that websites visited by the user send and store on his/her computer or mobile device, to be subsequently retransmitted to the same websites on the next visit. Thanks to cookies, a website remembers user’s behaviours and preferences (such as, for example, login data, chosen language, font sizes, other display settings, etc.) so that the same does not have to be entered again when the user returns to visit the mentioned website or browses from one page to another. Cookies, therefore, are used to perform computer authentications, session monitoring and storage of information regarding the behaviours of users that access a website and may also contain a unique identification code that allows to keep track of the user’s browsing history on the website for statistical or advertising purposes. When browsing a website, the user can also receive website or web server cookies different from the website he/she is visiting on his/her computer (so-called “third-party” cookies). Various operations may not be possible without the use of cookies, which in certain cases are technically necessary for the functioning of the website.


There are various types of cookies, depending on their characteristics and functions, these can remain on the user’s computer for different periods of time: so-called session cookies, which are automatically deleted when the browser is closed; so-called persistent cookies, which remain on the user’s equipment until a set deadline.


Express consent by the user is not always required pursuant to current Italian law. In particular, “technical cookies” do not require such consent, i.e. those used for the sole purpose of transmitting a communication over an electronic communications network, or to the extent strictly necessary to provide a service expressly requested by the user. In other words, these are cookies that are essential for the website to operate or necessary to perform activities requested by the user


Technical cookies, which do not require express consent for their use, the Data Protection Authority (see. Provision Identification of simplified methods for information and acquisition of consent for the use of cookies of 8 May 2014 and subsequent clarifications, hereinafter: “Provision“) also include:


    • • “analytic cookies” used directly by the website operator to collect information, in aggregate form, on the number of users and how they visit the website,


    • • browsing or session cookies (for authentication),


    • • functional cookies, that allow the user to browse according to a series of selected criteria, (e.g., language, products selected for purchase) in order to improve the service rendered to the same.


For “profiling cookies”, on the other hand, i.e. those aimed at creating user profiles and used in order to send advertising messages in line with the preferences expressed by the same in the context of surfing the net, the user’s prior consent is required.


Types of cookies used by the Website and possibility to disable the same

This type of cookies incorporates functions developed by third parties inside the Website pages such as icons and preferences expressed in the social networking websites in order to share Website contents or use third party software services (such as software for creating maps and further software offering extra services). These cookies are sent by third-party domains and partner websites offering their functions among the Website pages.


  • Third-party cookies, i.e. cookies from websites or web servers other than Kioene’s, used for the purposes of the mentioned third parties. It should be noted that these third parties, listed below with the links to their relevant privacy policies, are typically independent Data Controllers of data collected through the cookies provided by the same; therefore, you must refer to their data processing policies, information and consent forms (enabling and disabling of the respective cookies), as specified in the aforementioned Provision. For completeness, it is also specified that Kioene does its utmost to in order to track cookies on its Website. As regards third parties that send cookies via our Website, below are links to their respective privacy policies: we transfer to such third parties, as already specified, the responsibility to provide information and acquire your consent, as provided by the Provision. This responsibility refers not only to cookies that third parties send directly, but also to any additional cookies that are sent through our Website by virtue of the use of services that are used by such third parties. In fact, with respect to these cookies, sent by service providers of the aforementioned third parties, Kioene cannot exercise any control and has no knowledge of their characteristics or purposes.
